Adoption & Guardianship

In Singapore, adoption of a child is only recognized by a Court order. The Adoption of Children Act governs the process which includes the appointment of a guardian in adoption (replacing the hitherto guardian ad litem). The Ministry of Community Development, Youth and Sports ( MCYS) is involved in the writing up reports for the Courts and making recommendations on whether the adoption serves the welfare of the child . Upon an adoption order being made,   all rights, liabilities, obligations of the natural parents are extinguished. The child’s relationship with his adoptive parents stand on par with that of a natural child. 

The process can be complicated. Consents from natural parents of the child need to be obtained and in some cases, even the parents of the natural parents are brought in if they are under 21 years of age.  For Muslims, the issues are further complicated by the Islamic laws of inheritance of an adopted child.
